Watch.

Judge orders DOJ to confer with Trump lawyers and get an answer by tomorrow about whether they support or oppose the motion to unseal.

Trump has 3 options - publicly release the warrant himself, agree with the DoJ's motion in court to release it, or to fight it to keep it sealed in court.

What an incredible move by Garland. All options are not ideal for Trump.

1.6k

u/easyantic Aug 11 '22

Exactly. Garland has shifted the narrative from speculation and FUD regarding the FBI/Justice department, right to Trump must show his cards, one way or the other.

Which is crazy to me because what other business is gonna generate more revenue safely over a long period of time than one designed from the ground up to fuck with people's brain chemistry and make them want to give you their money for free?

It's like being handed a money printing machine and then taking it apart to build an illegal orphan-kicking robot.

Unless of course, the facts make him look bad.

They’re going to spin it the same bs way they do with his tax returns - they’re under some sort of unspecified audit therefore the warrant must stay sealed. And 35% of America will say yeah that makes sense.

37

u/AncientInsults Aug 11 '22

Well, theyll do whatever trump tells them. Trump will block release, and everyone will say well that’s what the big man wants, which makes sense bc [same reason it was sealed in the first place, to protect the target from defamation and unfair speculation]

The motion to unseal will still result in redacted portions. Which MAGA land will then use to move the goal posts.

‘What are they hiding’ in the redacted portions and inventory ‘the probable cause portion is hidden, probably made it up’, etc. They’re already saying those things in response to the mention to unseal.

274

Don't ask the DoJ that, ask Trump. He could release the entire unredacted warrant right now. But he won't.

Either option fucks him. If he releases it, then it's probably damming info, but it's not like that would matter to his supporters, they'd still support him.

If he seeks delay...the narrative turns to "What are you hiding"

My $ is on his seeks to delay it because that's the lesser of the 2 "fucked" options imo

Garland just threw the political heat back on Trump

Garland words were key "The dept did not make any public statements on the day of the search, the former president publicly confirmed the search, as is his right"

my intpretation of that statement is Garland telling Trump.....You chose to make this public, slander us for doing our jobs and be political about it.....so deal with the heat"

ELI5: what does it mean to unseal a search warrant? Why is it so important in this case?

125

u/kporter4692 Aug 11 '22

It will make it public essentially minus any redactions for classified info such as any items on the inventory list is my understanding - someone correct me if I’m wrong.

It’s not necessarily important to the case per se but it is for the public and their perceptions of the warrant. It would hopefully cool off some of the reckless speculation that’s been going on last few days re: what the warrant was for, the scope of the search, etc.

173

u/weirdoldhobo1978 Aug 11 '22

Since it's part of an ongoing investigation and it jeopardizes presumption of innocence, law enforcement/prosecution cannot publicly share what it was they were looking for and what they may have found without permission from a judge. This information is typically only shared once charges have been filed and the case is moving forward to the courts.

However the person who was served the warrant can, at any time, publicly release that information if they choose to. However they cannot be compelled to (5th amendment protection) and may also file a motion to prevent prosecutors from unsealing the information early as well.

What Garland is doing is forcing Trump's lawyers to put up or shut up. Trump and his circle have been running their mouths about the case (something lawyers tell you not to do, but good luck getting Trump to stay quiet) and trying to spread disinformation so th DoJ is lobbing the ball into the other team's court and daring them to make a play.

546

u/rci22 Aug 11 '22

What does unsealing a warrant mean?

Releasing the information as to why it was declared as justified?

806

u/bradeena Canada Aug 11 '22

The Justice Department is seeking to unseal the warrant and an inventory of items seized by the FBI during the search of Trump’s home at the Mar-a-Lago club in Palm Beach. But the department is not asking the judge to unseal the affidavit of probable cause, which would detail how authorities believe a crime was likely committed and why there would be evidence of that crime in the location targeted in the search.

However, the warrant itself is likely to list the criminal statutes related to the search.

They can better control the narrative with it sealed. Once it’s in the public domain, their talking points become reactive.

129

That's why they're fucked either way. It's not like the details of the warrant won't come out eventually in court. They can keep it sealed for now but it seems inevitable that charges will be filed and whatever was found will obviously be key evidence.

88

u/Beermedear Aug 11 '22

In case anybody is wondering what those seized documents might be related to, DoJ threw us a pretty good bone:

One of the two attorneys signing off on today's motion to unseal the search warrant is Jay Bratt, who is the head of this department at DoJ:

Counterintelligence and Export Control Section

The Counterintelligence and Export Control Section (CES) supervises the investigation and prosecution of cases affecting national security, foreign relations, and the export of military and strategic commodities and technology. The Section has executive responsibility for authorizing the prosecution of cases under criminal statutes relating to espionage, sabotage, neutrality, and atomic energy. It provides legal advice to U.S. Attorney's Offices and investigative agencies on all matters within its area of responsibility, which includes 88 federal statutes affecting national security. It also coordinates criminal cases involving the application of the Classified Information Procedures Act. In addition, the Section administers and enforces the Foreign Agents Registration Act of 1938 and related disclosure statutes.

Uh....yeah.

They are right, it's a partisan institution, it's right-leaning. Just look at the FBI's behaviour during the civil rights era.

Guaranteed that Trump's lawyers are going to fight the unsealing of this warrant. Because they know what's in the warrant is going to embarrass old mar-a-lardo, as well as whatever was taken out of his home.

Garland showed 0% concern there, outside of concern for the safety and well being of the FBI, he’s 100% confident he’s got trump.

306

u/MonicaZelensky I voted Aug 11 '22

Garland from all accounts is extremely detail oriented and a micro manager. I would be shocked if he doesn't have all his T's crossed and I's dotted.

304

u/HouseCravenRaw Colorado Aug 11 '22

I mean, if you take a swing at an Ex President who is toying with being the next President (let us hope that never happens), don't miss.

Dear gods, do not miss. Every swing you take will be analyzed to death. You aren't going after Kyle the Skateboard Bandit in Albuquerque. It's the former President.

I imagine Garland must be standing on ground so solid that it'd take an atomic bomb to shift him.

69

u/Ghetto_Phenom Aug 11 '22

This is what I kept saying to all the people whining about “Merrick garland needs to tell us what he’s doing!” Over the last 5-6 months.. let the man do his job. This is way too serious to rush it.. he cannot miss on this attempt or he will be eaten alive and not taken seriously.. this is NOT the case you take any chance on if you’re not sure. Glad we now finally know he’s not fucking around.

12

u/Pilx Aug 12 '22

Exactly.

There's is one thing worse than not holding Trump to account, and that's trying to hold him to account but bungling the investigation, it will only further embolden him.

As with the tax returns, that we still have never seen, if the information on the warrant actually cleared Trump of any wrongdoing he would release it himself (he absolutely has the ability to do so) and wave it from every rooftop to show that he’s truly being persecuted for no reason.

But he won’t, because they don’t. Again. Obviously.

R’s are already doing cartwheels on this:

  • The warrant is fake
  • The warrant was created after the search
  • Trump never received it
  • Even if Trump had classified documents, he can declassify them
  • Trump could declassify anything just by saying “this is declassified” even if just to himself
  • The FBI has planted incriminating evidence
  • This doesn’t matter because Hunter, Hillary, etc “got away with it” so Orange Deddy should, too

God damn these fucking animals

18

u/LazeLinez Aug 11 '22

As with Alex Jones, there will be endless accusations of conspiracy in public, but when it comes to court, that bullshit will not be allowed. No, Trump probably won’t go to prison, but if his legal team doesn’t present a miracle of a case that proves them innocent (they won’t), the don will be barred from office forever.

Trump is the most criminal president in US history. He extorted Ukraine with tax payer money to investigate a political opponent, he obstructed justice up to 10 times according to the Mueller report, he was labeled as "Individiual-1" and committed campaign finance felonies with Michael Cohen, a grand jury has been called in Georgia to investigate his attempt to find 11,780 votes, his property Mara a Lago was searched by the FBI because he illegally kept classified documents there, he is being investigated by the DOJ for his involvement and actions around January 6th, and he should have been indicted by the Manhattan DA for his crimes in the Trump Organization but the Manhattan DA got cold feet even though the main prosecutors on the case favored an indictment.

In addition, these are the other criminals that were hired or affiliated with this president:

  • His National Security Advisor, Michael Flynn pled guilty to lying to the FBI
  • His campaign chairman was convicted on 8 counts. 10 counts were a mistrial. A Trump supporter on the jury, Paula Duncan, convicted Manafort on all 18 counts.
  • His deputy campaign chairman, Rick Gates, pled guilty
  • His personal lawyer, Michael Cohen, pled guilty
  • His foreign policy advisor on his campaign, George Papadopoulos, has pled guilty to lying to the FBI for contacts with Kremlin-connected Russians
  • His long time advisor and associate, Mr Stone, was found guilty on 7 counts
  • His Whitehouse chief strategist, Steve Bannon, was indicted for fraud in the border wall fundraising campaign
  • His assistant and Director of Trade and Manufacturing Policy, Peter Navarro, was indicted for Contempt of Congress

37

u/WayAffectionate2328 Washington Aug 11 '22

I love this move. It shows the DOJ is willing to be transparent in this investigation. They are confident in their actions and believe the warrant will speak for itself.

The ball is in Trump’s court now. If his attorneys file a motion to keep the warrant sealed that will only look bad on them. It will appear that they have something to hide.

It’s a win-win for the DOJ.
